    Definitions of personal information, what constitutes a breach, and requirements for notice vary widely by state - requiring data set review to evaluate what was compromised and identify relevant information for each individual impacted based on their state of residence.

  • Evolving Legislation:

    New legislation proposals are being introduced with shorter reporting time frames and broader definitions of "personal information." In the U.S., data privacy laws are also being introduced at the national level.

  • Individual State Privacy Laws:

    The U.S. data privacy landscape expanded with the California Consumer Privacy Act (CCPA) in 2018, protecting all uniquely identifying data. Other states like New York, Maryland, Massachusetts, Hawaii, and North Dakota have enacted privacy laws with different requirements.

  • International Privacy Laws:

    The General Data Protection Regulation (GDPR) governs data privacy in the European Economic Area (EEA) and has broad reach. The UK implemented the GDPR through the Data Protection Act 2018. Other international countries and regions are expected to pass data privacy laws, including reforms in Australia and Canada.

  • Evolving Privacy Legislation:

    The National Biometric Information Privacy Act of 2020 (NBIPA) in the U.S. Senate may become a federal law that can be regulated and enforced for biometric data privacy.
